Starting early in December 2015, new Australia-wide laws have been implemented regarding illegal guns. Under the Firearms Act, anyone caught with three or more unregistered firearms over a 12-month period can be prosecuted for trafficking.

When a firearm is discovered by police, but those people present deny any knowledge of the weapon or claim it isn’t theirs, laws place the responsibility on the person/people present to prove the gun was not in their possession.

New gun offences introduced

  • The manufacture of firearms offence now in place carries a maximum of 10 years in prison.
  • The theft of a firearm offence now in place carries a maximum penalty of 15 years’ prison, increased from the previous 10 years.
