In probably one of the most unfortunate of circumstances, the suicide pact is a real defence that can be used if a death deal goes wrong. The suicide pact problem occurs when one of you survives because your suicide partner didn’t kill you, but you killed them, making you technically a murderer.

The suicide pact defence aims to downgrade the charge to manslaughter rather than murder, in a more humane treatment of a certain set of circumstances that don’t require intense punishments.

The jury must be satisfied that the death of the other person was due to a suicide pact, and give a verdict of manslaughter instead of murder. This has a maximum of 10 years in prison, with five years more usual.
